DEFINITIONS

Best Available Rate means a nightly room rate for a Participating Hotel that is available to the general public that does not require pre-payment and is the lowest generally available nightly room rate for that Participating Hotel offered online.

Company Administrator means the person or persons that have been nominated by the Company Entity Member to be its internal administrator, as  approved by the Program Operator. registered prior to 01 May 2013*

Primary Administrator means the individual who is first to receive an approved application by the Program Operator to be a Company Administrator for a Company Entity Member and has master account access for administration of the Company Entity Member account, including the ability to direct the pooling and redeeming of Reward Points by Company Employee Members registered prior to 01 May 2013*

Company Administrator Number means the number provided to the Company Administrator as their unique identifier when they are approved as a Company Administrator by the Program Operator registered prior to 01 May 2013*

Company Entity Member means a company, organisation, association, Government Department or other entity that the Program Operator approves as a Company Entity Member in the Program registered prior to 01 May 2013*

Company Employee Member means an individual employee of a Company Entity Member who travels for business purposes and for whom the Company Entity Member pays their Hotel Stay expenses and that the Program Operator approves as a Company Employee Member in the Program registered prior to 01 May 2013*

Company Member Discount means the tiered percentage discount off the Best Available Rate accessible to the Company Entity Member for Company Employee Member stays at Participating Hotels which is determined by the number of qualifying Hotel Room Nights booked by their Company Employee Members in a rolling 12 month period registered prior to 01 May 2013*

Company Reward Points means Reward Points earned by a Company Employee Member when staying at a Participating Hotel, where such stay is approved by the Company Entity Member and where the Company Administrator for the Company Entity Member has elected to Pool Points as outlined in these Terms and Conditions registered prior to 01 May 2013*

Conference and Events means certain meetings, conferences and events held at Participating Hotels.

Free Room Night means where a Member stays at a Participating Hotel using Reward Points and is not required to pay for the cost of the room. A Free Room Night covers the cost of a standard double room only.  It does not include breakfast and it does not cover other costs such as laundry, telephone internet, meals and drinks.  Such costs need to be paid by the Member on check-out.

Gold Priority Guest Rewards Member means an Individual Member or Company Employee Member who has attained Gold Membership status as outlined in these Terms and Conditions.

Hotel Room Night and Hotel Stay:  A “Hotel Room Night” means each individual night of a stay at a Participating Hotel. A “Hotel Stay” means all consecutive nights that a Member stays at a Participating Hotel – even if they have checked out and checked back in for consecutive nights. For example:
– if a guest stays for five consecutive nights this will be recorded as one “Hotel Stay” and five “Hotel Room Nights”;
– if a guest stays for one night only, this will be counted as both one “Hotel Stay” and one “Hotel Room Night”; and
– if a guest stays for one night, then checks out, then checks back in to stay for the subsequent night and then checks out this will be recorded as one “Hotel Stay” and two “Hotel Room Nights”.

Individual Member means a person that has been approved by the Program Operator to be an Individual Member in the Program and who is not a Company Employee Member.

Individual Member Discount means an entry level percentage discount of 10% that is available to Individual Members when they log in as an Individual Member at priorityguestrewards.com.au or Participating Hotel websites.  Member means a Member of the Program.  A Member may be either:

  1. an Individual Member (that is they are not a Company Employee Member);
  2. a Company Employee Member; or
  3. a Company Entity Member that has been approved to have Company Employee Members.

Membership means membership of the Program by a Member.

Membership Card means the card (or temporary online card) that is provided to each Individual Member and Company Employee Member by the Program Operator.

Membership Number means the number that is provided to an Individual Member, a  Company Employee Member or a Company Entity Member when they are approved by the Program Operator to be a Member of the Program.

Membership Profile means the details of the Member held online at priorityguestrewards.com.au

Member Rate means a special hotel nightly room rate that is only available to Members staying at a Participating Hotel.

Participating Hotel means a hotel or resort which operates under any of the brands Rydges, QT, Art Series, Abode by Rydges or such other brand as specified by the Program Operator from time to time (and which is participating in the Program).  For the current list of Participating Hotels please see priorityguestrewards.com.au.

Personal Reward Points means Reward Points earned when a stay at a Participating Hotel is booked online as outlined in these Terms and Conditions by an Individual Member or by a Company Employee Member where, in the case of a Company Employee Member, those earned Reward Points are not pooled to a Company Entity Member.

Platinum Priority Guest Member means an Individual Member or Company Employee Member who has attained Platinum Membership status as outlined in these Terms and Conditions.

Pooled Points means Reward Points that have been earned by a Company Employee Member and where the Company Administrator has elected to pool the Reward Points earned by its Company Employee Members into the Company Entity Member account registered prior to 01 May 2013*  New Roman”,”serif”;mso-fareast-font-family:”Times New Roman”; mso-ansi-language:EN-AU;mso-fareast-language:EN-AU;mso-bidi-language:AR-SA’> prior to 01 May 2013* 

Points Balance means the amount of available Reward Points in a Member’s account, be it an Individual Member, a Company Employee Member or a Company Entity Member.

Program means the Priority Guest Rewards Program.

Program Benefits means benefits and rewards that accrue to a Member in the Program as set out in Clause 4.

Program Operator means Rydges Hotels Ltd (ACN 050 035 268).

Program Partner means any Participating Hotel or other entity specified by the Program Operator who has agreed to participate as a Program Partner in the Program to offer Benefits to Members from time to time.

Qualifying Rate means the rate for Individual Members or Company Employee Members where the booking has been made as set out in Clause 4.1.2 and the Hotel Stay is subsequently completed and paid for in full.  Certain group bookings and other special promotional rates may not be a Qualifying Rate.  The person making any booking should check at the time if the rate they are booking is a Qualifying Rate and/or if that booking will be eligible for any or all Member benefits.

Qualifying Stay means a Hotel Stay which meets the criteria set out in these Terms and Conditions

Reward Points means Personal Reward points or Company Reward Points earned by a Member in the Program.

Terms and Conditions means these terms and conditions which apply to Members of the Program.

 

1.1 About these terms
These Terms and Conditions are for the Priority Guest Rewards Program. Your participation in the Program will be governed by these Terms and Conditions. It is a Member’s responsibility to read and understand them. We ask that you read them carefully.
For details of the Terms and Conditions of the separate Booker Priority Guest Rewards program please see priorityguestrewards.com.au/bookerprogram.

1.2 When these terms apply to you
These Terms and Conditions apply to you if you are a Member of the Program. Use of your Membership Card or your Membership Number signifies your acceptance of the Terms and Conditions.

1.3 Changes from time to time
The Program Operator may amend these Terms and Conditions, including Benefits of the Program, from time to time.

1.4 Types of Memberships
Membership may be held by a person or a company:
1.4.1. Membership by a person

Such a Membership may be held by a person who is (i) an Individual Member with no association with any company or organisation or (ii) a Company Employee Member where that person is an employee of and their Membership is linked to a Company Entity Member.

Memberships held by a person will fall into one of three tiers:

a.Entry level Priority Guest Member

b. Gold Priority Guest Member

c. Platinum Priority Guest member

1.4.2. Company Entity Membership (registered prior to 01 May 2103*)

Such a Membership may be held where a company or other organisation has been approved as a Company Entity Member by the Program Operator.

1.5 Cost
Members do not have to pay to join the Program.

1.6 Membership profile
A Member can update their Membership Profile online at priorityguestrewards.com.au

2 PROGRAM PARTNERS
The Program Partners (including the list of Participating Hotels) may vary from time to time.  Members should check at priorityguestrewards.com.au for the current listing of Program Partners.
3 MEMBERSHIP
3.1 Membership criteria for a person as an Individual Member or Company Employee Member (registered prior to 01 May 2103*)
  3.1.1 General Criteria:

Individual Membership or Company Employee Membership is for a person and provides that person will receive certain benefits as set out in these Terms and Conditions.

A person can hold an Individual Membership or Company Employee Membership if that person meets each of the following criteria:
a. The Program Operator has approved the individual’s  Membership application at its sole discretion;
b. The individual must reside in a country that permits the participation in a program like the Priority Guest Rewards Program;
c. The individual must be 15 years of age or older; and

d. The individual must provide and maintain details of a valid and unique email address for their Membership at the time of joining and for their period of Membership.

3.1.2 Criteria for different tiers of Individual Membership and Company Employee Membership:  

All Individual Members or Company Employee Members will fall into one of three tiers of the Program:

a. Entry level Priority Guest Tier:  At time of joining all Individual Members or Company Employee Members initially enter the Program as an entry level Priority Guest Member.  Such an individual will retain that Priority Guest Membership until either, (i) they qualify for a higher Membership tier, (ii) they terminate their Membership, or (iii) the Program Operator terminates their Membership.

b. Gold Priority Guest Tier:  To become a Gold Priority Guest Rewards Member, an individual must book and stay on a Qualifying Member Rate at Participating Hotels a certain number of Hotel Room Nights or Hotel Stays in a calendar year as specified by the Program Operator. To maintain the status of a Gold Priority Guest Rewards Member an individual must continue to stay a certain number Hotel Room Nights or Hotel Stays at Participating Hotels in the subsequent calendar year as specified by the Program Operator. Currently, 5 Hotel Stays or 15 Hotel Room Nights per calendar year is required to either attain or retain Gold Priority Guest Rewards Membership status.

c. Platinum Priority Guest Tier:  To become a Platinum Priority Guest Rewards Member, an individual must book and stay on a Qualifying Rate at Participating Hotels a certain number Hotel Room Nights or Hotel Stays in a calendar year as specified by the Program Operator. To maintain the status of a Platinum Priority Guest Rewards Member an individual must continue to stay a certain number of Hotel Room Nights or Hotel Stays at Participating Hotels in subsequent calendar year as specified by the Program Operator. Currently, 10 Hotel Stays or 25 Hotel Room Nights per calendar year is required to either attain or retain Platinum Priority Guest Rewards Membership status.

3.2 Membership criteria for a Company Entity Membership (registered prior to 01 May 2103*)

Membership as a Company Entity Member is for an organisation, so that organisation can receive certain benefits when their Company Employee Members stay at Participating Hotels.

An organisation can only be a Company Entity Member if it meets each of the following criteria:
a. The Program Operator has approved the organisation’s Membership application in its sole discretion;

b. The organisation provides all the necessary details of a person or persons to be the Company Administrator(s), including the Primary Administrator, at the time of application and keeps the Program Operator advised of any changes to such designated roles; and
b. The organisation must have a registered address in a country that permits the participation in a program like the Priority Guest Rewards Program as outlined in these terms and Conditions

 

3.3 Term of Membership
The term of Membership is from the date of enrolment until either:
a. termination of Membership by the Member; or
b. termination of Membership by the Program Operator.

4 PROGRAM BENEFITS

This section sets out the Program Benefits that are available to Members.

Please note that QT Sydney Hotel and QT Falls Creek are not full participating hotels within the PriorityGUEST Rewards program.

4.1 General
4.1.1. The Program Operator does not guarantee or warrant that any or all of the Program Benefits of the Program will be available at all times. The Program Operator reserves the right to change, modify, limit or cancel any of the Program Benefits at any time. This includes increasing or decreasing any requirements or eligibility to receive a Program Benefit , changing the value of rewards or limiting the availability of rewards. This also includes changing the list of Participating Hotels or changing Program Partners.
4.1.2 The full range of Member Benefits will only be available if the Member makes their reservation at a Participating Hotel using one of the following methods: (i) Direct online at priorityguestrewards.com.au or (ii) Direct online at the website of the Participating Hotel.
4.1.3 Where a Member is staying with a Participating Hotel as part of an airline or transport crew arrangement or as part of a convention or conference group, sporting team, education group or other group booking, the Program  Benefits may not be available at the relevant Participating Hotel. Members may confirm with the Participating Hotel in advance or at the time of check–in if their stay or spend is eligible for Program Benefits.
4.1.4 Certain Program Benefits are not available to Members who are staying at a Participating Hotel on a Free Room Night ( i.e. Reward Night Booking or any other free night). In particular, Members will not earn Reward Points on such stays nor will these stays count towards earning a higher membership tier status (Gold or Platinum level).

4.2 Individual Membership and Company Employee Membership (registered prior to 01 May 2103*) Program Benefits

4.2.1 The following Program Benefits apply to Individual Members and Company Employee Members on stays at Participating Hotels:
a. 
Welcome Back Beverage: With each stay a Member may have a complimentary beverage in the hotel restaurant or bar during that stay (excluding QT Sydney Hotel). The range of beverages available is at the discretion of the Participating Hotel, does not include beverages from the mini bar and in certain countries may be limited to respect local tradition or law.

b. Special rates for high speed internet: Members will receive a 50% discount on the full daily rate for wired in room high speed internet access, where such internet access is available at the relevant Participating Hotel.
c. Food and beverage discounts:

Entry level Priority Guest Rewards Members and Gold Priority Guest Rewards Members can receive a 20% discount on bills for food and beverage costs when dining at the Participating Hotels’ restaurants for up to 4 diners (Excludes QT Falls Creek from 01 June – 31 Oct 13).

Platinum Priority Guest Rewards Members can receive a 50% discount on bills for food and beverage costs when dining at a Participating Hotels’ restaurant. The Platinum 50% discount applies to a maximum of 2 diners with a 2 further diners (to a maximum of 4 diners) receiving a 20% discount. The maximum combined discount is capped at AUD$500 per Member per day (Excludes QT Falls Creek from 01 June – 31 Oct 13).

The discount on food and beverage bills will only apply where:
(i) the Member is present at the time;

(ii) there are 4 or less people dining at the table;  

(iii) there is a single bill;

(iv) the Member presents their Membership Card when the bill is presented, prior to payment or room charge and

(v) the Member is a registered guest at the Participating Hotel at the time.  

Local outlet exemptions and variations may apply to the food and beverage discount at certain Participating Hotels.  For details of any such exemptions please see priorityguestrewards.com.au.

The Member discount on food and beverage does not apply to mini bar, breakfast service, in-room dining or conference and meeting room catering and cannot be used in conjunction with any other offer or arrangement.
d. Late check-out: Entry level Priority Guest Rewards Members and Gold Priority Guest Rewards Members may request a late check-out of 1pmPlatinum Priority Guest Rewards Members may request a late check-out of 3pm.  Late check-out must be requested at least 12 hours prior to the Member’s scheduled departure. Late checkout requests are strictly subject to availability at the relevant Participating Hotel (excludes QT Sydney Hotel and QT Falls Creek) and for operational reasons are not guaranteed.

4.2.2 Additional benefits for Individual Members who book direct online at the Priority Guest Rewards Individual Rate
The following benefits apply to Individual Members who book direct online as set out in clause 4.1.2.

a. Special reduced room rates for Individual Members: Individual Members may usually receive a special room rate called an Individual Member Discount when booking Hotel Room Nights direct online at priorityguestrewards.com.au or direct online at Participating Hotels simply by logging on as an Individual Member and selecting one of the specially marked Priority Guest Rewards Individual Member Discount rates.  Certain group bookings may not qualify for the special reduced rate and Members should check at the time of booking of that is the case. (Excludes QT Falls Creek from 01 June – 31 Oct 13).

b. Earning Personal Priority Guest Reward Points for Individual Members:  Individual Members will receive Personal Reward Points for each paid eligible Hotel Room Night at a Participating Hotel booked on a Qualifying  Individual Member Discount Rate. Individual entry level Priority Guest Rewards Members will receive ten Personal Reward Points per eligible Hotel Room Night. Individual Gold Priority Guest Rewards Members will receive fifteen Personal Reward Points per eligible Hotel Room Night. Individual Platinum Priority Guest Rewards Members will receive twenty Personal Reward Points per eligible Hotel Room Night.

If more than one Member stays in a room, only one Member can accrue the Personal Reward Points for that stay.

If a Member books, pays in their name and is a guest in one of the rooms, they may earn Personal Reward Points for up to three rooms for any Hotel Room Night.

Certain promotional room rates may not be eligible to earn Personal Reward Points.  The Individual Member should check with the relevant Participating Hotel at the time of booking that the booking is eligible for Personal Reward Points.

4.3 Company Entity Membership Benefits (registered prior to 01 May 2013*) 

The following benefits apply to Company Entity Members:

4.3.1 Special Company Discount: Company Entity Members may usually receive a special discount for any stay by their employees who are Company Employee Members, when booking Hotel Room Nights direct online at priorityguestrewards.com.au or direct online at Participating Hotels as outlined in clause 4.1.2, simply by logging on as a Company Entity Member and selecting the specially marked Company Discount Rate (Excludes QT Sydney Hotel amd QT Falls Creek).

  • Where a Company Entity Member has booked under its Company Entity Membership up to twenty five Hotel Room Nights for its Company Employee Members within a rolling 12 month period then a Company Discount of 10% off the Best Available Rate shown at priorityguestrewards.com.au or on the Participating Hotels website at that time may apply to the booking.
  • Where between twenty five to seventy five Hotel Room Nights have been booked within a rolling 12 month period on a Company Discount then an additional 5% (that is total 15%) off the Best Available Rate shown on the Participating Hotels website at that time may apply to the booking.
  • Where more than seventy five Hotel Room Nights have been booked within a rolling 12 month period on a Company Discount then an additional 5% (that is total 20%) off the Best Available Rate shown on the Participating Hotels website at that time may apply to the booking.

Certain group bookings may not qualify for the special reduced rate and Members should check at the time of booking of that is the case.

4.3.2 Earning Company Priority Guest Reward Points for Company Entity Member or Company Employee Members:

Room stays at Participating Hotels by Company Employee Members that are booked by their Company Entity Member at the Qualifying Company Discount Rate earn Reward Points.  If the Company Administrator for the Company Entity Member has elected to pool its points, these points will become Company Reward Points.  Company Reward Points will automatically be pooled and held in aggregate for the Company Entity Member.  Those pooled Company Reward Points can be used by the Company Entity Member to redeem Free Room Nights as outlined below.

Where a Company Employee Member is booked at the Company Discount rate and the Company Administrator for the Company Entity Member has elected that such points be pooled, then no Personal Reward Points are awarded to the Company Employee Member for that stay.

4.3.3 Where a Company Entity Member does not seek to pool points.

The Company Administrator for a Company Entity Member can choose to book and receive the Company Discount rate associated with any of their Company Employee Member stays, but  elect to not have the Reward Points associated with that booking credited and so pooled to the Company Entity Member as Company Reward Points.  In this instance:

  • the Reward Points associated with that stay will be credited to the relevant Company Employee Member and recorded as Personal Reward Points in the Company Employee Member’s account;
  • but the stay will still count towards the number of nights credited to the Company Entity Member in determining the Discount Rate that applies to their Company Employee Member bookings.

 

4.4. Redeeming Reward Points 

Members may use accumulated Reward Points to redeem Free Room Nights at Participating Hotels subject to the following Terms and Conditions (excludes QT Sydney Hotel):

(i) Individual Members and Company Employee Members can only use accumulated Personal Reward Points from their own Membership to redeem Free Room Nights.  They cannot pool Personal Reward Points with any other individual or organisation.  However, Company Administrators can use accumulated pooled Company Reward Points within their Company Entity Member account to redeem Free Room Nights.

(ii) They must book direct online at priorityguestrewards.com.au or direct online at the Participating Hotels website as outlined in clause 4.1.2.

(iii) Free Room Nights are subject to availability. Room inventory available for Priority Guest Reward Point redemption is limited and once booked at any Participating Hotel on any given night, additional Free Room Nights will not be made available. Members should plan and book their Free Room Night redemptions well in advance to ensure the greatest possibility of securing their preferred Free Room Night dates. QT Sydney & QT Falls Creek does not participate in offering redemption nights for the complimentary nights when members utilise their points.
(iv) A Member may book sequential Free Room Nights, subject to having sufficient points to do so and subject to availability of rooms for Free Room Nights on desired dates. Members may also book a Free Room Night that is immediately prior to or after a non-Free Room Night stay.
(v) If a Member books a Free Room Night with a Participating Hotel and prior to using the Free Room Night that hotel is no longer a Participating Hotel, the Program Operator will use reasonable efforts to have the hotel honour the reservation. However, in this instance, the Program Operator cannot guarantee that the Free Room Night will be honoured and, if not, the Reward Points will be credited back to the Individual Member’s account.

(vi) Reward Points cannot be refunded for cash. Except in the case of clause 4.4(v), once Reward Points have been redeemed for a reward, the redemption cannot be reversed. That is, the points cannot be refunded.
(vii) Points expiry:

  • Until 31 October 2012: For points to remain active, the Member (be they an Individual Member, Company Employee Member or Company Entity Member) must have a points earning activity in the prior 36 months. As such, if there is no activity for a period of 36 months, then any points earned more than 36 months previously will expire.
  • From 1 November 2012: For Reward Points to remain active and available for future redemption, the Member (be they an Individual Member, Company Employee Member or Company Entity Member) must have a Reward Points earning activity in the prior 18 months. If a Member has not had any Reward Points earning activity over an 18 month period (Non-Active Period), then all Reward Points earned by such Member at any time before the end of the Non-Active Period will automatically expire. Furthermore, regardless of a Member’s Reward Points earning activity, any Reward Points that have not been utilised 36 months after they were earned by a Member will automatically expire.

5 MEMBERSHIP CARD, MEMBERSHIP NUMBER AND ACTIVATION OF MEMBERSHIP

5.1 The Program Operator will issue Individual Members and Company Employee Members with a Priority Guest Rewards Membership Card
Following the Program Operator accepting an Individual Member’s or Company Employee Member’s application for Membership, the Program Operator will provide that Member with a Membership Card.  Each card has a unique Membership Number.  The Membership Card is not transferable and must not be used by any person other than the Member to secure any of the Program Benefits.

5.2 Activation of Membership and delivery of Individual Membership and Company Employee Membership Cards
If an Individual Member or Company Employee Member has completed an online application form, the Member will be provided with an online version of a Membership Card and associated details. Once a person has this, the person will be classified as a Member and can use the temporary Membership Card to obtain certain Program Benefits and earn Reward Points. Regardless of the method of enrolment, the Program Operator operates a ‘first stay” fulfilment model for the delivery of the permanent Membership Cards to Members. When a Member makes their first eligible booking the system automatically sends a request to the corresponding hotel for hotel staff to provide a new Membership card to that Member at check-in.

5.3 Security of Individual Membership Card and Membership Number
The Member must keep the Membership Card secure at all times. If the Membership Card is lost or stolen, the Individual Member must immediately advise the Program Operator.
5.4 Individual Membership Cards for Gold and Platinum Priority Guest Members.
a. Each Gold Priority Guest Rewards Member and Platinum Priority Guest Rewards Member will receive a distinctive Membership card. Gold Priority Guest Rewards Members and Platinum Priority Guest Rewards Members will receive a Membership card that has an expiry date. After that expiry date, the card will not be valid.
b. If, after the expiry date on the Card the Member still meets the criteria to retain their Gold or Platinum tier status, the Program Operator will provide the Member with a new Membership Card at the same tier level. If the Member does not meet the criteria to be retained at their present tier, the Member will be issued with a new Membership Card for one tier lower than their prior tier status.   If the Member meets the criteria to move to a higher tier, the Member will be issued with a new Membership Card for the higher tier for which they now qualify.
c. The Member’s existing balance of Personal Reward Points is retained if and when a Member changes status from any one tier to another.

5.5 Replacement of lost or stolen Individual Membership Cards
Members may be charged a fee of $10 for the replacement of lost or stolen membership cards to cover the administration, postage and handling costs.
5.6  The Program Operator will issue Company Entity Members and Company Administrators with a Priority Guest Rewards number only
Following the Program Operator accepting a Company Entity Member’s or Company Administrator’s application for participation in the Program, the Program Operator will provide that Company Entity Member and each Company Administrator with a Membership Number.  Each Company Entity Member and each Company Administrator will have their own unique Membership Number.  However, the Company Entity Member or Company Administrator will not receive a Membership card.

It is the responsibility of each Company Entity Member and Company Administrator to ensure their Membership Number is only used in a manner consistent with these Terms and Conditions.

 

5.7 Use of accurate Member details
A Member must accurately record or quote their Membership name and number when making bookings or seeking to receive the Program Benefits.   If they do not, or any third party making a booking on their behalf does not, the Program Operator cannot ensure that the Program Benefits will be received by the Member.

The Program Operator shall be entitled to assume that any person that purports to be a Member and provides (whether in person or through any electronic, telecommunications or other media) the Membership name and number to the Program Operator is in fact the Member. The Program Operator shall be entitled to:
– reveal to any such person any and all information relating to their Membership and Membership bookings, and
– treat and act on any request of such a person with respect to any other matter regarding the Program without taking any further steps to verify the identity of the person.

6 TERMINATION AND LIABILITY

6.1 Misuse of Membership
If in the Program Operator’s reasonable opinion, a Member is using their Membership in an abusive or fraudulent way, has failed to comply with these Terms and Conditions, has committed any unlawful act, or causes wilful damage to the Program Operator’s property, the Program Operator may at its election:
a. immediately terminate the Membership;
b. suspend a Membership temporarily until further notice;
c. reverse or cancel any Priority Guest Reward Points and, or other Program Benefits that a Member has accrued; or
d. refuse to honour the redemption of Priority Guest Reward Points.

6.2 Termination on death of person who is  Member
On the death of a person who is a Member the Membership will automatically terminate.

6.3 Termination on the cessation of a Company
Should a Company Entity Member cease to operate, become insolvent, have a receiver or administrator appointed, or an application commenced to dissolve or wind up a Company Entity Member then (a) the Membership of the Company Entity Member will automatically terminate and (b) the Membership of all Company Employee Members linked to that Company Entity Member will also automatically terminate.

6.4 Termination without cause
The Program Operator may terminate the Program at any time without cause.

6.5 Consequences of termination
All benefits, offers and rewards will be forfeited on termination of a Membership or termination of the Program.  The Program Operator (and its related bodies corporate and Program Partners ) will have no further liability to any Member on termination of the Member’s membership or on termination of the Program.

6.6 Liability
To the extent permitted by law (and without limiting the application of the Australian Consumer Law and the Consumer Guarantees):
a. the Program Operator (and its related bodies corporate and Program Partners) is not liable to a Member for any indirect or consequential loss or damage of any kind including loss of profits and loss of revenue; and
b. the maximum aggregate liability of the Program Operator(and its related bodies corporate and Program Partners) in connection with the Program, whether for breach of this Agreement or in tort (including negligence) or otherwise is $10.

7 GENERAL

7.1 Governing law
These terms and conditions of the Program are governed by the laws in force in New South Wales. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

7.2 Tax liability
Rewards and offers that are available to Members may be subject to tax liability. The Member is responsible for those taxes.

8 Company Program Changes

8.1 Effective from May 1 2013
As of 01 May 2013, no new enrolments will be accepted in the Priority Guest Reward Company program as outlined in the terms and conditions above.

Current Priority Guest Reward Company program registered prior to 01 May 2013 and in receipt of PC number between PC001 – PC9000 along with their affiliated, linked individual Priority Guest Rewards members will continue to receive the program’s benefits, tier room night discounts and other stated entitlements as above until 31\12\2013.
